These Terms of Service are governed and interpreted in accordance with the laws of Spain and the European Union. By using our services, you accept these terms and our Privacy Policy. The official version of these terms is the English version published on this website. In case of discrepancies between translations, the English version shall prevail.

Scope (B2B and consumers): These terms apply to professional users (B2B) and to consumers. Where consumer protection laws apply, the mandatory rights of consumers will prevail over any conflicting provision of these Terms.

Minimum Age: You must be at least 14 years old to use our services. If you are under 14, do not use our services or provide personal data. If we become aware that we have collected personal data from a child under 14 without verified parental consent, we will take steps to delete that information as soon as possible. If a parent or guardian becomes aware that their child has provided us with personal data without their consent, they should contact us at: secretaria@alzaobrasyservicios.com.

Please read these Terms of Service carefully before accessing or using our services. For your convenience, we have included a brief non-binding summary before the full legal terms.

Definitions

Short version: We use these basic terms throughout the agreement, and they have specific meanings. You should know what we mean when we use each term.

The “Agreement” refers to all the terms, conditions, and notices in this document (the “Terms of Service” or the “Terms”) and all other operational rules and policies, including our Privacy Policy, that we may publish from time to time on the website.

The “Service” refers to the applications, software, products, and services provided by Alza Real Estate.

The “Website” refers to the Alza Real Estate website, and all content, services, and products provided by Alza Real Estate on or through the website.

The “User”, “You”, and “Your” refer to the person, company, or organization that has visited or is using the website or the Service; who accesses or uses any part of the Account; or who directs the use of the Account in the performance of their duties. A User must be at least 14 years old.

“Alza Real Estate”, “We”, and “Our” refer to Alza Real Estate, as well as our affiliates, directors, subsidiaries, contractors, licensors, officers, agents, and employees.

“Content” refers to content presented or displayed through the website, including but not limited to text, data, articles, images, photographs, graphics, software, applications, designs, features, and other materials available on the website or otherwise available through the service. “User Generated Content” is content, written or otherwise, created or uploaded by our Users. “Your Content” is the content you create or own.

An “Account” represents your legal relationship with Alza Real Estate. A “User Account” represents the authorization of an individual User to log in and use the Service and serves as the identity of a User on Alza Real Estate. “Organizations” are shared workspaces that may be associated with a single entity or with one or more Users where multiple Users can collaborate on many projects at once. A User Account can be a member of any number of Organizations.

Account Terms

Short version: User Accounts and Organizations have different administrative controls; a person must create your Account; you must be 14 or older; you must provide a valid email address. You are solely responsible for your Account and anything that happens while you are logged in or using your Account. You are responsible for keeping your Account secure.

Account Controls

Users: Subject to these Terms, you retain ultimate administrative control over your User Account and the Content within it.
Organizations: The “owner” of an Organization created under these Terms has ultimate administrative control over that Organization and the Content within it. Within the Service, an owner can manage User access to Organization data and projects. An Organization can have multiple owners, but there must be at least one User Account designated as the owner of an Organization. If you are the owner of an Organization under these Terms, we consider you responsible for actions taken on or through that Organization.

Required Information

You must provide a valid email address, name, and phone number to complete registration. Any other information requested is optional, unless you accept these terms on behalf of a legal entity (in which case we will need more information about the entity).

Account Requirements

You must be a natural person to create an account. Accounts registered by “bots” or other automated methods are not allowed. We allow machine accounts only for automated tasks under the responsibility of a natural person.
You must be at least 14 years old. If you are under 14, do not use our services or provide personal data.
Your access is personal and non-transferable. Do not share your credentials with others.

User Account Security

You are responsible for maintaining the security of your account and password. Alza Real Estate will not be liable for any loss or damage resulting from your failure to comply with this obligation. Notify Alza Real Estate if you detect unauthorized use of your account.

Additional Terms

In some cases, third-party terms may apply to your use of Alza Real Estate, for example, if you are a member of an organization with its own agreements or use external integrations. These third-party terms govern only your relationship with those third parties.

Legal Compliance

Your use of the site and service must comply with applicable law, including intellectual property laws, data protection, and any other current regulations.

Intellectual Property

The content, software, trademarks, and logos of Alza Real Estate are protected by intellectual property rights. You may not copy, modify, distribute, sell, or rent any part of our services or the included software, except with express written authorization from Alza Real Estate.

Content Restrictions

You may not upload, publish, host, or transmit content that:

Is illegal or promotes illegal activities;
Is pornographic or contains sexually explicit material;
Is defamatory, fraudulent, or abusive;
Is discriminatory or incites hatred;
Contains malware or attempts to exploit the platform;
Infringes third-party rights, including intellectual property.

Conduct Restrictions

You may not use the site for unlawful purposes or those prohibited by these terms, nor take actions that may harm Alza Real Estate, other users, or third parties, or interfere with the operation of the site. Specifically, you may not:

Impersonate another person or entity, or misrepresent your identity.
Perform scraping, harvesting, or automated data collection without authorization.
Attempt to breach site security.
Distribute unauthorized material or spam.
Engage in any conduct that limits other users' use of the site.

Account Suspension and Termination

Alza Real Estate reserves the right to suspend or terminate your account and access to the service in case of breach of these terms, without prior notice if the violation is serious or repeated.

Disclaimer of Warranties and Limitation of Liability

Use of the site is at your own risk. The site is provided “as is”, without any warranties. Alza Real Estate does not guarantee availability, accuracy, or error-free operation, and will not be liable for damages resulting from use of the site.

Consumer Safeguards

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any non-waivable rights of consumers under applicable law. Where mandatory consumer rights apply, those rights prevail.

Right of Withdrawal (Consumers)

If you are a consumer and the service is not executed immediately, you have 14 calendar days from acceptance of these Terms to withdraw without cost by contacting secretaria@alzaobrasyservicios.com. If you request immediate execution of the service or its full performance before the end of the withdrawal period, you acknowledge that you lose the right of withdrawal once the service has been fully performed.

Extended Limitation of Liability

Alza Real Estate will not be liable, in any case, for indirect, incidental, special, consequential, or punitive damages, including, without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your access to or use or inability to access or use the service; (b) any conduct or content of third parties on the service; (c) any content obtained from the service; and (d) unauthorized access, use, or alteration of your transmissions or content.

Data Protection and Privacy

We process your personal data in accordance with the GDPR and Spanish law. You have the right to access, rectify, erase, restrict, or object to processing, as well as data portability and to file complaints with the AEPD. More information in our Privacy Policy.

Alternative Dispute Resolution (ADR/ODR)

If you are a consumer resident in the EU, you can access the European Commission's online dispute resolution platform: https://ec.europa.eu/consumers/odr/. Alza Real Estate is not obliged to participate, but will consider it in good faith.

Changes to the Terms

Alza Real Estate may modify these terms at any time. We will notify material changes at least 30 days in advance by notice on the website. If you do not agree with the new terms, you must stop using the service before they take effect. Continued use of the site implies acceptance of the new terms.

Governing Law and Jurisdiction

These terms are governed by the laws of Spain and the European Union. Any dispute will be submitted to the courts of Spain, unless otherwise provided by law. If you are a consumer resident in the EU, mandatory rules on jurisdiction and applicable law for consumers may allow you to bring actions in the courts of your domicile.
